Utility Buddy collects IP addresses for the purposes of system administration, security and the generation of marketing analytics.

Utility Buddy collects nonpublic personal information from its Users in order to build usage and conversion profiles on prospective clients and in order to provide the best products, services and support possible to our existing customer base. Personal information does not include de-identified or aggregate consumer information or information that is lawfully made available from federal, state, or local government records.  Personal information is not considered to have been disclosed by a business when a consumer instructs a business to transfer the consumer’s personal information from one business to another in the context of switching services. 

Utility Connect of America, LLC retains consumers’ personal information as reasonably necessary and proportionate to achieve the purposes for which the personal information was collected or processed. Utility Connect of America, LLC has not sold or shared any consumer’s personal information to any third parties in the preceding twelve months. We continue to work on features to keep consumer information safe.

Retention. When you sign up for an account with us, we’ll retain information you store on our Services for as long as your account exists or as long as we need it to provide you the Services. If you delete your account, we will initiate deletion of this information after 30 days. But please note that: (1) there might be some latency in deleting this information from our servers and back-up storage; and (2) we may retain this information if necessary to comply with our legal obligations, resolve disputes, or enforce our agreements.

Your Rights Regarding Your Personal Information

Access to Specific Information. You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, you must submit a verifiable consumer request to us by following the instructions found at https://www.utilitybuddy.com/contact-us-ca. Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
  • We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

Upon receiving a request to know or a request to delete, we will confirm receipt of the request within 10 business days and provide information about how we will process the request. The information provided will describe in general our verification process and when you should expect a response, except in instances where we have already granted or denied your request.

We will respond to requests to know and requests to delete within 45 calendar days. If we cannot verify your request within the 45- day time period, we may deny your request. If necessary, we may take up to an additional 45 calendar days to respond to your request, for a maximum total of 90 calendar days from the day the request is received.

If we require more time, we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance, specifically by electronic mail communication.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Personal Information Sales Opt-Out and Opt-In Rights

If you are 16 years of age or older, you have the right to direct us to not sell your personal information at any time (the “right to opt-out”). We do not sell the personal information of consumers we actually know are less than 16 years of age, unless we receive affirmative authorization (the “right to opt-in”) from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age. Consumers who opt-in to personal information sales may opt-out of future sales at any time. Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back in to personal information sales at any time by visiting our website and sending us a message. We will only use personal information provided in an opt-out request to review and comply with the request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.

Nevada Internet Privacy Policy

Definitions

COMPANY means [Utility Connect Of America, LLC], a registered COMPANY.

NVPL means the Nevada Internet Privacy Law of 2019.

Responsible Person means [John Mashtare within the COMPANY].

Register of Systems means a register of all systems or places in which personal data is controlled or processed by the COMPANY.

Data protection principles
The COMPANY is committed to processing data in accordance with its responsibilities under the NVPL, and, in particular, with regard to the principles articulated therein which provide Nevada consumers (as defined therein and below, certain Nevada residents “Consumers”) specified safeguards regarding covered personal information (as defined therein and below “Covered Information”).

  2. A consumer (“Consumer”) is a Nevada resident who seeks to acquire or in fact does acquire, by purchase or lease, any good, service, money or credit for personal, family or household purpose from the Internet website or online service of the COMPANY.
  3. Covered information (“Covered Information”) means any one or more of the following items of personally identifiable information about a Consumer collected by the COMPANY through its Internet website or online service and maintained in an accessible form: (1) a first and last name, (2) home or other physical address which includes the name of a street and the name of a city or town, (3) an electronic mail address, (4) a telephone number, (5) a social security number, (6) an identifier that allows a specific person to be contacted either physically or online or (7) any other information concerning a person collected from the person through our Internet website or online service and maintained by us in combination with an identifier in a form that makes the information personally identifiable.
  4. A sale (“Sale” or “Sales”) of Covered Information of a Consumer is a sale for monetary consideration to another person for the person to license or sell that information to additional persons.
  5. The Responsible Person shall take responsibility for the COMPANY’s ongoing compliance with this Policy. 
  6. This Policy shall be reviewed at least annually. 
  7. The COMPANY shall comply with an order of the Nevada Attorney General.
  8. To ensure its processing of data is lawful, fair and transparent, the COMPANY shall maintain a Register of Systems, which shall include a list of systems, co-controllers, processors and sub-processors. 
  9. The Register of Systems shall be reviewed at least annually. 


Right to Opt-Out

  1. The COMPANY shall provide a Consumer with the ability to give notice to the COMPANY, at any time, directing the COMPANY to stop all Sales by the COMPANY of Covered Information of the Consumer.
  2. The COMPANY shall establish a designated request address (meaning an email address, toll-free number or Internet website) for the Consumer to submit a verified request to stop Sales by the COMPANY of Covered Information of the Consumer.
  3. The COMPANY shall be able to reasonably verify the authenticity of a request by a Consumer to stop Sales by the COMPANY of Covered Information of the Consumer.
  4. The COMPANY shall respond within 60 days of a verified request submitted by a Consumer (or extend the period if reasonably necessary for no more than 30 days after notice to the consumer of the need for an extension).
  5. The COMPANY shall, upon receipt of verified notice from a Consumer not to sell their Covered Information stop all Sales of the Covered Information it has collected or will collect for monetary consideration to a person for the person to license or sell the Covered Information to additional persons.


Right to Notice and Information

The COMPANY shall, make available in a manner reasonably calculated to be accessible by Consumers whose Covered Information is collected through our Internet website or online service, a notice that:

  • identifies the categories of Covered Information collected about consumers who use or visit the Internet website or online service and the categories of third parties with whom we may share such Covered Information;
  • provides a description of the process, if any such process exists, for an individual consumer who uses or visits the Internet website or online service to review and request changes to any of his or her Covered Information that is collected through the Internet website or online service;
  • describes the process by which we notify Consumers who use or visit the Internet website or online service of material changes to the notice required to be made available by the NVPL;
  • discloses whether a third party may collect Covered Information about an individual Consumer’s online activities over time and across different Internet websites or online services when the Consumer uses our Internet website or online service; and
  • states the effective date of the notice.

The COMPANY shall remedy defects in the notice it provides under NVPL within thirty days of being informed and periodically verify the accuracy of its notices.
